Welcome to Sola Bible App ("Sola," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Sola Bible App mobile application, our website, and any related services (collectively, the "Service").

Please read these Terms carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, downloading, accessing, or using the Sola Bible App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

We may amend these Terms from time to time. We will notify you of any material changes by posting the new Terms within the app, on our website, and/or through other communications. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Sola Bible App provides users with a comprehensive Bible study experience, including but not limited to:

  • Access to various Bible translations.
  • Scripture reading and navigation tools.
  • AI-powered scripture search, summarization, and contextual information ("AI Features").
  • Original language study tools.
  • Daily devotionals and reflections.
  • Note-taking, journaling, highlighting, and bookmarking functionalities.
  • Premium features available through subscription, which may include enhanced AI capabilities or additional content.

3. User Accounts

  • Registration: To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
  • Security: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. Sola cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
  • Eligibility: You must be at least 13 years old (or 16 in certain jurisdictions, or older if required by your country of residence) to create an account and use the Service. If you are under the age of majority in your jurisdiction, you represent that your legal guardian has reviewed and agreed to these Terms.

4. License to Use the Service

Sola grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms.

5. Acceptable Use Policy

You agree not to, and not to permit others to:

  • Use the Service for any illegal, harmful, or unauthorized purpose.
  • Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on any portion of the Service.
  • Interfere with or disrupt the operation of the Service or the servers or networks used to make the Service available.
  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
  • Use any robot, spider, site search/retrieval application, or other manual or automatic device to retrieve, index, "scrape," "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
  • Attempt to gain unauthorized access to any Sola accounts, computer systems, or networks.
  • Violate any applicable national or international laws or regulations.
  • Misuse the AI Features by, for example, attempting to discover underlying components, generating hateful, abusive, or illegal content, or making excessive or burdensome queries that could degrade the service for others.
  • Remove any copyright, trademark, or other proprietary rights notices contained in or on the Service.

6. User-Generated Content

  • Your Content: You may create, upload, or store content within the Service, such as notes, journal entries, highlights, and bookmarks ("User Content"). You retain all ownership rights to your User Content.
  • License to Sola: By creating User Content, you grant Sola a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, reproduce, display, modify (for formatting purposes), and distribute your User Content solely for the purpose of providing, maintaining, and improving the Service for you (e.g., syncing your notes across devices, enabling search of your notes). This license ends when you delete your User Content or your account, except to the extent your User Content has been shared with others and they have not deleted it, or for residual backup copies.
  • Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to grant the licenses herein and that your User Content does not violate any third-party rights (including intellectual property or privacy rights) or applicable laws.
  • No Monitoring Obligation: We are not obligated to monitor User Content but reserve the right to review and remove User Content that violates these Terms or is otherwise objectionable, in our sole discretion, without notice.

7. AI-Powered Features

  • Purpose: Our AI Features are designed to assist your Bible study by providing contextual information, verse recommendations, summaries, and answers to your scripture-related questions.
  • Limitations & Disclaimers: You acknowledge that AI-generated output may not always be accurate, complete, or reflect all theological viewpoints. AI Features are tools to aid understanding and are not a substitute for scholarly research, professional theological advice, pastoral guidance, or personal discernment. Sola does not endorse, and is not responsible for, the accuracy or reliability of any AI-generated content.
  • Usage: Your use of AI Features is subject to the Acceptable Use Policy (Section 5). Free access to AI Features may be subject to usage limits. Unlimited or enhanced access may be available through our Premium Features.
  • Data Use for AI: Please see our Privacy Policy for details on how data related to your use of AI Features may be processed.

8. Premium Features and Subscriptions

  • Premium Services: We may offer certain enhanced features, content, or functionalities through a subscription-based service ("Premium Features").
  • Subscription Fees: If you subscribe to Premium Features, you agree to pay the applicable fees as described at the time of purchase. Fees are typically billed on a recurring basis (e.g., monthly or annually).
  • Payment: We use a third-party payment processor to handle payments. Your payment is subject to the terms and conditions and privacy policy of that processor. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.
  • Automatic Renewal: Subscriptions may automatically renew for successive periods unless you cancel your subscription before the end of the then-current billing period through your app store account (e.g., Apple App Store or Google Play Store) or as otherwise directed in the app.
  • Cancellation: You can cancel your subscription at any time. Cancellation will take effect at the end of the current billing period, and you will retain access to Premium Features until then.
  • Refunds: Subscription fees are generally non-refundable, except as required by applicable law or as explicitly stated in our refund policy (if any) at the time of purchase.
  • Price Changes: We reserve the right to change subscription fees. We will provide you with reasonable prior notice of any price changes, giving you an opportunity to cancel your subscription before the new fees take effect.

9. Intellectual Property

All rights, title, and interest in and to the Service (excluding User Content and publicly available or third-party licensed Bible texts), including its software, design, text, graphics, logos, trademarks, service marks, and other content and intellectual property, are and will remain the exclusive property of Sola and its licensors. The Service is protected by copyright, trademark, and other laws of US and foreign countries.

Some Bible translations provided within the Service may be subject to copyright by their respective publishers and are used under license. You agree to respect all such copyrights and use such content only as permitted by the Service.

10. Termination

  • By You: You may terminate your account and stop using the Service at any time by following the account deletion process within the app or by contacting us.
  • By Us: We may suspend or terminate your access to the Service and your account, at our sole discretion, at any time and without notice or liability to you, including if you breach these Terms, if we are required to do so by law, or if we discontinue the Service or parts of it.
  • Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your User Content upon termination or as described in our Privacy Policy, subject to applicable law. Provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

SOLA DOES NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, ERROR-FREE, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE, INCLUDING ANY INFORMATION OR CONTENT (SUCH AS AI-GENERATED CONTENT), WILL BE ACCURATE, RELIABLE, COMPLETE, OR MEET YOUR REQUIREMENTS OR EXPECTATIONS.

INFORMATION PROVIDED THROUGH THE SERVICE, INCLUDING AI-GENERATED CONTENT AND CONTEXTUAL INFORMATION, IS FOR INFORMATIONAL AND STUDY PURPOSES ONLY AND SHOULD NOT BE CONSIDERED PROFESSIONAL THEOLOGICAL, PASTORAL, FINANCIAL, LEGAL, OR COUNSELING ADVICE. YOU SHOULD CONSULT WITH QUALIFIED PROFESSIONALS FOR SUCH MATTERS. YOUR RELIANCE ON ANY INFORMATION PROVIDED BY THE SERVICE IS SOLELY AT YOUR OWN RISK.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOLA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING AI-GENERATED CONTENT; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (E) ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE OR OTHERWISE ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (I) THE TOTAL AMOUNT YOU PAID TO SOLA, IF ANY, IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS (USD $100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU IN FULL.

13. Indemnification

You agree to defend, indemnify, and hold harmless Sola and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service, by you or any person using your account; (b) your violation of these Terms; or (c) your User Content.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will use reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

15. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service will be resolved exclusively in the state or federal courts located in Laguna Niguel, CA, USA, and you consent to the jurisdiction and venue of such courts.

16. General Terms

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sola concerning the Service and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic).
  • Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or any other rights. A waiver of any term or condition of these Terms will be effective only if in writing and signed by an authorized representative of Sola.
  • Assignment: These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Sola without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
  • Notices: Any notices or other communications provided by Sola under these Terms, including those regarding modifications to these Terms, may be given: (i) via email; (ii) by posting to the Service (e.g., through an in-app notification); or (iii) by other means of communication. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.
  • Headings: The section headings in these Terms are for convenience only and have no legal or contractual effect.
